Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VPN and secure connectivity services ("Services") provided by VAIZEN, OSOO. Registration number 225289-3301-OOO, TIN 01412202310122, Tynystanova St., Office 38, Pervomaisky District, Bishkek, Kyrgyzstan ("Operator", "we", "us", or "our"), operating the platform iguard.one.

By creating an account, purchasing, or using the Services, you agree to these Terms together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Refund Policy(collectively, the "Agreement"). If you do not agree, you must stop using the Services immediately.

These Terms apply to all users of the Services worldwide. Additional provisions applicable to users in specific countries are set out in Section 13 (Country-Specific Terms).

General Provisions

1.1 Nature of Services

We provide a subscription-based VPN and secure connectivity platform that encrypts your internet traffic and routes it through our private server infrastructure, enabling private and secure internet access. We are not an Internet Service Provider or telecommunications operator; you must independently arrange for internet access.

We do not monitor or log your browsing activity, traffic content, or DNS queries. The Services are designed and provided for lawful purposes: protecting your data on public and untrusted networks, securing remote work, and keeping your online activity private. The Services are not designed, marketed, or intended for use in circumventing any applicable law. You are solely responsible for ensuring that your use of the Services complies with all applicable laws in your jurisdiction.

1.2 Service Updates

We may improve, update, or modify the Services from time to time. If a change materially reduces the functionality of the Services you have paid for, we will notify you in advance and give you an opportunity to cancel before the change takes effect.

1.3 Changes to Terms

We may update these Terms by posting a new version on our website with a new "Last Updated" date. Material changes will be communicated via email or in-product notice where possible. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

1.4 Equipment and Connectivity

You are responsible for providing and maintaining your own internet connection, devices, and software necessary for using the Services.

1.5 Third-Party Links

Our website may contain links to third-party websites or applications. We do not control or endorse third-party resources and are not responsible for their content or availability.

Eligibility and Account Registration

2.1 Eligibility

You must be at least 18 years of age to use the Services. By registering, you represent and warrant that you meet this requirement and that your use of the Services does not violate any applicable law in your jurisdiction.

2.2 Account Registration

You agree to provide accurate, complete, and up-to-date information during registration and to keep it updated.

2.3 Security

You are responsible for safeguarding your login credentials and must notify us immediately if you suspect unauthorized use of your account. Until you do, all actions taken under your account are considered authorized by you.

Subscriptions, Payments, and Renewals

3.1 Plans and Pricing

Subscription options and prices are listed on our website. Prices are shown inclusive of applicable taxes where required. Annual plans are charged as a single upfront payment for the full annual amount stated at checkout; monthly plans are charged monthly. We may update prices for future billing cycles with advance notice.

3.2 Payment

Payments for subscriptions purchased directly on our website are processed by Paddle.com Market Limited ("Paddle"), which acts as the merchant of record for those purchases. Paddle handles billing, tax calculation and remittance, and payment processing, and your purchase is subject to Paddle's buyer terms in addition to these Terms. Charges may appear on your statement as "Paddle.net".

In the event of a conflict between Paddle's buyer terms and these Terms in respect of the payment transaction itself, Paddle's terms prevail; these Terms govern the provision and use of the Services. For purchases made through the Apple App Store or Google Play, the respective platform acts as the merchant of record and processes all billing, renewals, and refunds according to its own terms.

3.3 Automatic Renewal

Unless you cancel, your subscription will automatically renew at the end of each billing period at the then-current price for that plan. Before each renewal, we will notify you in advance with the renewal date, price, and a clear and simple way to cancel.

3.4 Cancellation

You may cancel at any time via your account dashboard. Your subscription will remain active until the end of the current billing period.

3.5 Money-Back Guarantee and Refunds

iguard.one offers a 30-day money-back guarantee for the first subscription purchased directly through our website. If you request a refund within 30 days of your first purchase, we will refund the full amount paid, without deduction for the period of use.

Renewals, upgrades, and add-ons may be refunded if requested within 7 days of the charge date. Refunds for purchases processed by Paddle are issued by Paddle to the original payment method, normally within 10 business days. Refunds in respect of payments made in cryptocurrency are issued in the equivalent amount at the exchange rate applicable on the date the refund is processed.

3.6 Purchases via Apple App Store

Billing, renewals, and refund requests for App Store purchases are handled directly by Apple Inc. under the Apple Media Services Terms and Conditions. iguard.one cannot issue or modify such refunds.

3.7 Failed Payments

If payment cannot be processed, we may suspend or restrict access to the Services until payment is successfully completed.

3.8 Chargebacks

If we receive a chargeback or payment dispute in respect of your subscription, we may suspend access to the Services until the matter is resolved. We encourage you to contact our support team before initiating a dispute, as most issues can be resolved directly and more quickly.

3.9 Statutory Right of Withdrawal (EU/EEA and UK consumers)

If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you have a statutory right to withdraw from this Agreement within 14 days of purchase, without giving any reason.

Where you have expressly requested that we begin providing the Services before the end of the withdrawal period and have acknowledged that you will lose your right of withdrawal once the Services have been fully performed, you may still withdraw within the 14-day period, but we may charge you a proportionate amount for the Services provided up to the point of withdrawal.

This statutory right applies in addition to, and does not limit, the 30-day money-back guarantee set out in Section 3.5. In practice, where the money-back guarantee gives you a more favourable outcome, we will apply the money-back guarantee.

Acceptable Use

You agree not to misuse the Services. In addition to the restrictions set out in our Acceptable Use Policy, you may not:

  • •use the Services for any activity that is unlawful in your jurisdiction or in the jurisdiction of the server through which you connect;
  • •use the Services to circumvent content restrictions, website blocks, or telecommunications regulations where such circumvention is prohibited by applicable law;
  • •use the Services in violation of third-party rights, including intellectual property rights;
  • •transmit unlawful, harmful, hateful, defamatory, or infringing content;
  • •attempt unauthorized access, hacking, or security breaches of any system or network;
  • •use the Services for spam, malware distribution, or denial-of-service attacks;
  • •share your account with unauthorized persons or exceed simultaneous connection limits;
  • •resell, sublicense, or otherwise make the Services available to third parties without our prior written consent;
  • •initiate fraudulent chargebacks or payment disputes, or use fraudulent, stolen, or unauthorized payment credentials.

We may suspend or terminate accounts to protect our network, enforce these Terms, or comply with legal obligations, including lawful requests from competent authorities.

Privacy

We process only the minimum data required to deliver and secure the Services. We do not log browsing history, traffic contents, or DNS queries. Please refer to our Privacy Policy for full details.

Our data practices are designed to comply with the EU General Data Protection Regulation (GDPR), the UK GDPR, and, in respect of residents of the United Arab Emirates, UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data. Details of our representatives for the purposes of Article 27 GDPR and Article 27 UK GDPR are set out in our Privacy Policy.

Service Availability and Fair Use

We strive to ensure reliable and continuous operation of the Services but cannot guarantee that they will be uninterrupted or error-free. We may implement reasonable limits to maintain service quality for all users, as detailed in Section 3 (Fair Use of Network Resources) of our Acceptable Use Policy.

Disclaimer

The Services are provided "as is" and "as available." To the extent permitted by applicable law, we make no warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Connection speeds, server locations, and performance may vary depending on your device, network, and geographic location.

Nothing in this Section affects statutory warranties or guarantees that cannot be excluded under the law applicable to you as a consumer.

Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages — including loss of profits, revenue, business interruption, or data — even if such loss was foreseeable. Our total aggregate liability for all claims in any twelve (12) month period will not exceed the total fees you paid for the Services during that same period.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from any claims, liabilities, and expenses (including reasonable legal fees) resulting from your breach of these Terms, your violation of applicable law, or your misuse of the Services.

Suspension and Termination

We may suspend or terminate your access, with notice where reasonably practicable, if you:

  • •breach these Terms or the Acceptable Use Policy;
  • •fail to pay subscription fees;
  • •use the Services in a manner that violates applicable law or risks the security or integrity of our network.

You may terminate the Agreement at any time via your account. Cancellation rules in Section 3 apply.

Dispute Resolution

We encourage you to contact us in the first instance to resolve any concerns informally, at legal@iguard.one.

If a dispute cannot be resolved amicably, it shall be referred to the competent courts of the Kyrgyz Republic, without prejudice to any mandatory consumer protection rights available to you under the law of your country of residence, including any right to bring proceedings before the courts of that country.

Governing Law

These Terms are governed by the laws of the Kyrgyz Republic.

If you are a consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of your country of habitual residence.

Country-Specific Terms

The provisions in this Section apply to users accessing the Services from the countries specified and prevail over conflicting provisions elsewhere in these Terms in respect of such users. In all other respects, the remainder of these Terms continues to apply.

13.1 United Arab Emirates

The following provisions apply to users accessing the Services from the United Arab Emirates ("UAE") and prevail over conflicting provisions elsewhere in these Terms in respect of such users.

(a) Lawful use.

The use of VPN services to access content that is blocked or restricted under UAE law, to circumvent UAE telecommunications regulations, or to engage in any activity prohibited under UAE law is strictly forbidden and constitutes a breach of these Terms. See also our Acceptable Use Policy.

(b) Additional restrictions.

In addition to the restrictions in Section 4, users in the UAE may not use the Services for any activity that is illegal under UAE federal or emirate-level law, or to circumvent content restrictions, website blocks, or telecommunications regulations imposed under UAE law.

(c) Applicable UAE legal framework.

These Terms are supplemented by the following UAE legal framework:

  • •Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrime ("Cybercrime Law") — prohibits the use of VPN services to commit or facilitate any crime or to access blocked content;
  • •Telecommunications and Digital Government Regulatory Authority (TDRA) regulations — govern the use of internet services in the UAE;
  • •Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data ("UAE PDPL") — governs the processing of personal data of UAE residents.

We reserve the right to comply with all lawful requests from UAE competent authorities as required by applicable law.

(d) Liability and disputes.

Nothing in these Terms limits or excludes liability that cannot be excluded under UAE law. For users in the UAE, disputes that cannot be resolved amicably may be referred to the competent courts of the UAE, without prejudice to any mandatory consumer protection rights available under UAE law.
